Site Rules

TGM is a friendly community for those who love golf! Please be on your best behavior as you interact with others. Failure to follow these rules will result in your account being closed.

Interacting with Members

TGM is a safe place for people to come and enjoy. There should be no abusive language, personal attacks, threats, or any other unkind behaviour.

Keep It Clean

You may not post any offensive content on TGM including your username, avatar, or personal description. You may not add any offensive comments, chat, or other content. The following behavior is prohibited and can result in your being banned: cheating, using offensive/vulgar language, using toilet humor, making personal attacks, spamming or advertising competitive websites, religious or political debate, intentionally pointless/distracting posts, and discussion of illegal activities (drugs, etc).

Only One Account

Members may only have one TGM account. Members who create more than one account may have all accounts closed. Please read this entire page for all rules, terms, policies, and agreements on TGM.

Privacy Policy

This policy covers how TGM treats personal information that it collects and receives, including information related to your past use of TGM products and services. Personal information is information about you that is personally identifiable like your name, address, email address, or phone number, and that is not otherwise publicly available. This policy does not apply to the practices of companies that TGM does not own or control, or to people that TGM does not employ or manage. In addition, certain TGM services may have their own associated privacy statements. In the case of device users e.g. Iphone, Ipad, Apple Watch, we do not share this information with third parties and we do not allow such parties to advertize with the app.

Collecting Information

TGM collects personal information when you register with TGM, when you use TGM products or services, when you visit TGM pages or the pages of certain TGM partners, and when you enter promotions or sweepstakes. TGM may combine information about you that we have with information we obtain from business partners or other companies. When you register we ask for information such as your name, email address, birth date, gender, zip code, occupation, industry, and personal interests. Once you register with TGM and sign in to our services, you are not anonymous to us. TGM automatically receives and records information on our server logs from your browser, including your IP address, TGM cookie information, and the page you request. TGM uses information for the following general purposes: to customize the advertising and content you see, fulfill your requests for products and services, improve our services, contact you, conduct research, and provide anonymous reporting for internal and external clients.

You understand and agree that the Service is provided “AS-IS” and that TGM does not assume any liability for personal information stored through our Service. You accept that the Service may include advertisements. TGM reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that TGM shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

Registration

In consideration of your use of the Service, you represent that you are of legal age to form a binding contract. You also agree to:

Member Accounts

While many portions of the Service do not require registration, you may register as a user of TGM to enjoy greater access or privileges. If you choose to register you will receive a username and password upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify TGM of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. TGM cannot and will not be liable for any loss or damage arising from your failure to protect your account.

You acknowledge, consent and agree that TGM may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any Content violates the rights of third parties; (d) respond to your requests for customer service; or (e) protect the rights, property or personal safety of TGM, its users and the public.

Communications

From time to time we will communicate with you via email or other means, to give you information related to the use and operations of this site. You will not be able to opt out of these communications except by requesting your account be terminated. We will also send you regular email reports, such as our weekly newsletter or weekly reports. We will endeavor to provide you the ability to opt out of these communications.

Account Limitations

You acknowledge that TGM may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that email messages, message board postings or other uploaded Content will be retained by the Service, the maximum number of email messages that may be sent from or received by an account on the Service, the maximum size of any email message that may be sent from or received by an account on the Service, the maximum disk space that will be allotted on TGM’s servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree that TGM has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Service. You acknowledge that TGM reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that TGM reserves the right to modify these general practices and limits from time to time. Without restricting the scope of the above paragraph, the Golf Mentor will delete accounts that have no posts, have opted out of receiving emails, and have been inactive after three months, and any account that is inactive for a period of one year.

Termination

In general, your usage should constitute fair use. You agree that TGM may, under certain circumstances and without prior notice, immediately terminate your TGM account, any associated email address, and access to the Service. Cause for such termination shall include, but not be limited to, (a) breaches or violations of the TOS or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, (g) engagement by you in unfair use, fraudulent or illegal activities, and/or (h) nonpayment of any fees owed by you in connection with the Services. Termination of your TGM account includes (a) removal of access to all offerings within the Service, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring of further use of the Service. Further, you agree that all terminations for cause shall be made in TGM’s sole discretion and that TGM shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Service.

TGM may place advertisements and promotions on the website or in emails sent to members. These can be pictorial, text, advertorial or take other forms. TGM can be paid commission or pay per click for these advertisements and promotions.

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that TGM shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

Because TGM has no control over such sites and resources, you acknowledge and agree that TGM is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that TGM shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

Proprietary Rights

You acknowledge and agree that the Service and any necessary software used in connection with the Service ( "Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or by advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. TGM respects the intellectual property rights of others. If you believe something on this Site has infringed your intellectual property rights, please notify us and provide the following information: (i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. General Information

The Terms of Service constitutes the entire agreement between you and TGM and governs your use of the Service, superseding any prior agreements between you and TGM with respect to the Service. The TOS and the relationship between you and TGM shall be governed by the laws of the State of NSW, Australia without regard to its conflict of law provisions. Paid subscriptions to TGM and other services on this site are governed by the following terms and agreement:

Payments

Payments for subscriptions can be made via credit card or PayPal. All subscriptions are in the designated currency at the time of purchase. All credit card subscriptions are auto-renewed until cancelled by the subscriber (by contacting support).

Services

Subscribers can expect to receive the services outlined on the subscription page for the duration of their subscription. Services are effective and available immediately upon receipt of payment.

Upgrades/Downgrades

Upgrading can be done at any time and the upgrade price will be pro-rated according to the time used and time remaining. The upgrade price will show in the checkout process/cart. Downgrades are not available until after the expiration of the original subscription. To downgrade please contact support. If you have any questions regarding the above policies please contact us.

Teaching Professionals

Teaching professionals are governed by the other terms and conditions of the site. In addition the following terms and conditions apply.

To join as Teaching Professional, you need to belong to a recognized golfing professional association or golf teaching professional association. They should act with the normal high standards of golf teaching professionals.

Students can use the Golf Mentor for free. Teachers must introduce the student to the Golf Mentor by either using the New Student or the Invite Student functions on their Dashboard. This method of introduction will be refered to as personally introduced. The students must also be the personal students of the teaching professional and any single teaching professional cannot have more than 500 students members of TGM, without the written consent of TGM. If a Teachers trial period finishes without the teacher upgrading to a premium membership, then the Teacher's students no longer enjoy free usage of the Golf Mentor. At the completion of the trial period, if the teacher does not upgrade to premium membership, all the student accounts may be deleted and all the Teacher's videos can also be deleted.

The Golf Mentor is meant for teaching purposes. Normal use would be posting one or two videos per face to face lesson, each video being a few minutes long. Any actions to subvert this model is not fair use of the Golf Mentor and can result in termination of the Teacher's membership. Examples of such subversion is recording a very large number of videos, or posting very long videos.

Teachers must treat the information posted by their students as confidential. Students may become aware of their Teaching Professionals email address. Teachers are also expected to monitor their students fair usage of the Golf Mentor.

A teaching professional can terminate an account by sending an email to [email protected]. After confirming the email, and checking all student subscriptions have completed, the account will be deleted and the teaching professional will not be eligible to receive any further revenues from the date of termination. If the teaching professional has an outstanding balance due, the remaining balance will be paid within 90 days.

Teachers will not use the Golf Mentor to send spam emails. Examples of such behaviour would be to send emails or join a student up to the Golf Mentor without their explicit consent.

Chat Services

Monthly Usage Limit

The customer's monthly subscription includes access to the AI Chat service. The user may only ask questions for the purpose of improving their own golf game.

Each interaction with the AI Chat service consumes tokens for the conversation history, the customer's input (prompt), and the AI-generated response (completion). The number of tokens used per interaction can differ based on the content and context of the conversation.

The current monthly token limit is 125000. The usage limit is defined by the total number of tokens consumed, and the subscription covers a pre-determined number of tokens per month. Once the token limit is reached, the customer may not be able to use the AI Chat service until the next billing cycle commences, or they may choose to purchase additional tokens (if available).

We do not expect any customer to exceed the token limit. But we reserve the right to review and adjust the token limit on a per-customer basis, as needed, to ensure fair usage and maintain service quality. Customers will be notified in advance of any changes to their token limits.

To monitor your token usage and avoid exceeding the limit, you can track your usage within the application or contact our support team for assistance.

Please be aware that consistently exceeding the token limit may result in additional charges or changes to your subscription plan. It is the customer's responsibility to manage their usage in accordance with the allocated token limit.
